The gas company Lenape (John Holko) and his Pennsylvania lawyer Michael Joy are suing the Town of Avon and the DEC over Avon's moratorium on new gas drilling. Despite the fact that existing gas wells are not affected by the moratorium, Lenape is seeking $50 million in damages. John Holko also represents IOGA-NY, the Independent Oil and Gas Association of New York, and Lenape's lawsuit needs to be considered in its wider context of an industry backed effort to discourage towns in New York from exercising their rights of home rule. The Town of Avon, much like the Town of Dryden and Middlefield before, is the industry's latest attempt to overturn bans and moratoria on gas drilling and related activities.
